NEW MILFORD – A Cornwall man who police said used a piece of heavy construction equipment to assault another person is scheduled to appear in state Superior Court in Bantam next month.
Brian Johnson, 50, faces charges of second-degree assault on a person over 60 and disorderly conduct as a result of the incident on Ridge Road Monday, police said.
Johnson, who was at the controls of an excavator, was arguing with the victim and struck him with the bucket of the machine, police said.
He’d left the scene by the time police arrived, but returned at their request and was arrested a short time later. The victim declined medical attention.
Johnson was released after posting a $2,500 bond. He is due in court on Dec. 9.
