DANBURY – The wife of the 41-year-old city man who was killed in February when the Metro-North train he was riding in smashed into an SUV on the tracks and caught fire has filed a notice to sue the commuter railroad.
An attorney representing the wife of India-born cricket enthusiast Aditya Tomar said the railroad and others recognized the dangers of the track crossing in Valhalla, N.Y., where the accident happened but did not make improvements.
“(W)e believe the dangerous layout of the intersection, together with the lack of adequate warnings and signage for the approaching motor vehicle traffic, was a substantial factor in causing this crash,” said attorney Paul Edwards.
Four other men in the front car of the train died, along with the driver of the SUV.
The notice to sue, known as a notice of claim, is the first step to filing a lawsuit.
